In this policy: 

Invigorate means INVIGORATE RECOVERY PTY LTD ACN: 686 189 417 and all its corporate associates. 

Modality refers to any individual recovery service offered by the Provider, including but not limited to Ice Baths, Magnesium Baths, and Compression Boots

Minor means a person under the age of 18 years.

Participant means any person, organisation, or representative who books, participates in or is provided with the Services.

Provider means trained staff of Invigorate and Invigorate as an entity.

Services means the services offered by Invigorate. 

Social Media means the Invigorate Recovery Instagram and any other social media accounts as operated by Invigorate from time to time. 

Venue means any physical location at which the Provider sets up or offers Services, including gyms, parks, sporting grounds, or business premises.

Website means the website available at https://www.invigorate-recovery.com.au/ and any other website operated by Invigorate from time to time. 

1. Introduction

Invigorate is committed to best practice in relation to the management of the information we collect. This practice has developed a policy to protect patient privacy.  This policy shall set out:

  • the kinds of information that we collect and hold, which, as a wellness practice, may include ‘health information’ for the purposes of the Privacy Act;

  • how we collect, share, and hold personal information;

  • the purposes for which we collect, hold, use, and disclose personal information;

  • how you may access your personal information and seek the correction of that information;

  • how you may complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint; and

  • how we use your information for promotional purposes and similar. 

2. What kinds of personal information do we collect?

The type of information we may collect and hold includes:

  • Your name, address, date of birth, email, and contact details;

  • Your IP address; 

  • Your medical history, including allergens, medical conditions and recent illness;

  • preferences and opinions; and

  • any other information requested on the Invigorate Website, to be completed on any disclaimer form or similar, or otherwise requested by us or provided by you.


Your use of the Invigorate Website: As with most businesses, we may log information about your access and use of the Website, including through the use of Internet cookies, your communications with the Website, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider.


Your opinion and feedback: We may contact you to voluntarily respond to questionnaires, surveys or market research to seek your opinion and feedback.  Providing this information is optional to you.

3. How do we collect and hold personal information?

We will generally collect personal information:

  • at events as a precondition to your participation in any Modality; 

  • from you directly when you provide your details to us. This might be via a face-to-face discussion, telephone conversation, registration form (including as submitted on the website or social media), or other online form. 

4. Why do we collect, hold, use, and disclose personal information?

In general, we collect, hold, use, and disclose your personal information for the following purposes:

  • to provide Modalities to you and ensure your suitability to participate in any Modality; 

  • to provide relevant information to any applicable Provider engaged by us and, in particular, any Provider who shall perform any Modalities on you;

  • provide promotional content through email and other channels as determined by you;

  • to communicate with you in relation to the service being provided to you; 

  • to comply with our legal obligations; ;

  • to help us manage our accounts and administrative services, including billing, pursuing unpaid accounts, and managing our systems;

  • when it is required or authorised by law (eg court subpoenas);

  • when it is necessary to lessen or prevent a serious threat to a patient’s life, health or safety or public health or safety, or it is impractical to obtain the patient’s consent;

  • to establish, exercise, or defend an equitable claim;

  • for the purpose of confidential dispute resolution process;

  • to supply third parties who work with Invigorate for business purposes, such as accreditation agencies or information technology providers – these third parties are required to comply with this policy;

  • when there is a statutory requirement to share certain personal information;

  • for identification and insurance claiming; and

  • for promotional purposes, subject to this Privacy Policy

Only people who need to access your information will be able to do so. Invigorate will not sell your personal information to any third party. Invigorate will not disclose your personal information to anyone outside Australia (unless under exceptional circumstances that are permitted by law) without your consent.

Invigorate will not use your personal information for marketing any of our goods or Modalities directly to you without your express consent, which consent shall be provided when you engage Invigorate for the provision of Modalities. If you do consent, you may opt out of direct marketing at any time by notifying Invigorate in writing or selecting unsubscribe as provided. 

Our Website contains links to other websites, including Social Media sites. You should take care in providing personal information to external websites linked to the Website. We are not responsible for the privacy practices of other websites or external websites linked to this Website. Please refer to Instagram's privacy policies and those of any other website linked to the Website from time to time. 

We may provide your contact data (such as email addresses) and other de-identified demographic data to third-party social media accounts for promotional and marketing purposes. All such information provided is subject to the Meta privacy policy. We are not responsible for enforcing the Meta Privacy Policy, and make no assurances or warranties as to its compliance or enforceability. 

5. How can you access and correct your personal information?

You have a right to seek access to, and correction of, the personal information which we hold about you. We may charge a reasonable fee for collating any information requested.

We will normally respond to your request within 30 days.

6. How do we hold your personal information?

We are committed to ensuring that the information you provide is secure. Your personal information may be stored at Invigorate in various forms, including:

  • As paper records (eg. waiver, onsite ‘contact us’ form)

  • As electronic records (eg. Google Forms)

  • As visuals, videos & photos

Invigorate stores all personal information securely, whether in electronic format, in protected information systems which are encrypted with secure passwords, or in hard copy in secured cabinets.  Invigorate uses a secure network and server.

Our staff are trained and required to respect and protect your privacy. We take reasonable steps to protect information held from misuse and loss and from unauthorised access, modification or disclosure. This includes:

  1. Holding your information in secure cloud storage; 

  2. Not making additional copies or duplications; 

  3. Ensuring all of our staff sign confidentiality agreements;

  4. Ensuring all hardware through which your information is stored securely. 

No information transmitted over the Internet can be guaranteed to be secure. We cannot guarantee the security of any information that you transmit to us or receive from us.  The transmission and exchange of information is carried out at your own risk. All Invigorate’s employees and service Providers are obliged to respect the confidentiality and security of any personal information held by Invigorate. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

7. Privacy-related questions and complaints

If you have any questions about privacy-related issues or wish to complain about a breach or the handling of your personal information by us, you may lodge your complaint in writing to (see below for details).  We will normally respond to your request within 30 days.

8. Anonymity and pseudonyms

You have the right to deal with Invigorate anonymously or under a pseudonym, unless it is impracticable for us to do so or unless we are required or authorised by law to deal only with identified individuals.

The Privacy Act provides that individuals must have the option of not identifying themselves, or of using a pseudonym, except in certain circumstances, such as where it is impracticable for us to deal with you if you have not identified yourself.

9. Minors 

Invigorate is sensitive to privacy issues and is proud of our commitment to our customers. Invigorate does not intend to collect personal information from any person under the age of 18 years without the consent of a parent or legal guardian. We urge parents to regularly monitor and supervise their children’s online activities.

10. Updates to this Policy

This Policy will be reviewed from time to time to take account of new laws and technology, changes to our operations, and other necessary developments. Invigorate has the discretion to update this privacy policy at any time without prior notification. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications. You can determine when this Privacy Policy was last revised by referring to the date it was “Last Updated” below.
